Dental Malpractice Charges Filed After Baby’s Death During Dentist Visit

What is dental malpractice and what are my rights if I am a victim of dental malpractice?

The parents of a 14-month old girl are mourning the loss of their young child following what should have been a routine dental procedure.  The child went to a dentist in Texas, where her parents were informed she needed two cavities filled.  Later, the dentist suggested four crowns as well. The baby was put under anesthesia while the Texas dentist performed surgery on several of her baby teeth.  She never woke up from the procedure.

Now, the parents of the deceased baby are suing the dentist that performed the procedure for dental malpractice related to, what they believe, was an unnecessary surgery.  Investigations post-mortem revealed no evidence of dental disease in the child, despite the dentist’s aggressive surgical procedures.

Dental Malpractice Causes Injuries and Claims Lives

Dental malpractice generally refers to injuries or death caused by a negligent dentist.  Negligence could include failure to diagnose and treat a dangerous condition, unnecessary treatment or surgery, causing severe injury during treatment, and anesthesia errors.  With over 150,000 practicing dentists across the country, a significant number of dental malpractice cases arise each year.  Dental malpractice can lead to serious injuries in the mouth, including nerve damage, as well as life threatening infections and even death.
